A Last Will and Testament is a legal document that expresses the maker’s (testator’s) wishes as to how their property (estate) will be distributed upon their death. It usually names a person or entity (executor) to manage the estate until its final distribution to the recipients (beneficiaries). Proceedings regarding the will are usually held in the Probate Court.
Dying without a valid will or living trust, is called dying intestate, which means the state becomes the executor of the estate, and uses the state laws of intestacy to decide how to distribute the property.
